on conducting regulatory impact analysis and public consultations for the draft Resolution of the Cabinet of Ministers of the Kyrgyz Republic "On approval of the rates and procedure for accrual, payment, collection and collection of arrears of the fee for withholding licenses for the right to use subsoil"

The Ministry of Natural Resources, Ecology and Technical Supervision of the Kyrgyz Republic (hereinafter referred to as the Ministry) hereby informs about the beginning of the discussion of legal regulation and the collection of proposals from interested parties.

1. Description of the problems that the proposed regulation is aimed at solving (describe using appropriate quantitative and qualitative indicators):

The draft resolution of the Cabinet of Ministers of the Kyrgyz Republic (hereinafter referred to as the draft) is being developed in pursuance of the instructions of the Chairman of the Cabinet of Ministers of the Kyrgyz Republic No. 26-33 dated November 01, 2021 and No. 26-4654 dated November 17, 2021 in order to maintain and develop the mineral resource base of the country, to encourage subsoil users to accelerate and complete the study of the subsoil by reducing the retention fee rates licenses. The draft also approves the Procedure for calculating, paying, collecting and collecting arrears of the fee for withholding licenses for the right to use mineral resources in a new edition with the elimination of existing conflicts and inaccuracies.

In order to implement this task, an interdepartmental working group will be formed by order of the Ministry, with representatives of government agencies and business communities for a versatile approach in the preparation of the draft NPA.

Currently, work is underway to develop a project with an analysis of the current legislation of the Kyrgyz Republic and similar legislation of other countries for possible adaptation in our country.

2. Description of the purpose of the proposed regulation (describe using appropriate quantitative and qualitative indicators) and the method of solving problems (basic regulatory norms):

The purpose and objective of this project is:

- improvement of legislation on subsoil use;

- elimination of internal contradictions, legal conflicts, gaps in legislation, updating of legislation;

- stimulating non-users to accelerate and complete exploration of the subsoil by reducing the fee rates for license retention.

3. Assessment of the expected benefits and advantages of the proposed regulation (describe using appropriate quantitative and qualitative indicators):

The adoption of the draft will eliminate internal contradictions, legal conflicts, gaps in legislation.

4. Assessment of possible adverse effects (describe using appropriate quantitative and qualitative indicators):

Adverse consequences are not expected.

5. Characteristics and assessment of the number of business entities - addressees of the proposed regulation (describe using appropriate quantitative indicators):

Business entities are legal entities and individuals who have the right to use the subsoil.

6. A rough estimate of the additional costs and benefits of potential recipients of the proposed regulation associated with its introduction:

Subsoil users will not incur additional costs.

At the same time, subsoil users will receive additional benefits due to the reduction of the fee rates for holding the license.

7. Approximate assessment of the costs and benefits of the budget of the Kyrgyz Republic associated with the introduction of the proposed regulation:

The adoption of this draft will not entail additional financial costs from the republican budget.
